These Website Terms of Use (“ToU”) set forth the agreement between MT4talk, a business based in and governed by the laws of Austria (hereinafter referred to as “MT4talk”, “we”, “our”, and “us”) and each user (“you” or “your”) making use of the (i) website www.mt4talk.com (“Website”), and (ii) Services (as further defined below) provided by MT4talk via the Website.

You and MT4talk shall hereinafter be referred to together as the “Parties” and individually as a “Party”.

Please read these ToU carefully before using the Website. These ToU shall apply to you, all users and other persons who access the Website and/or use the Services.

1. Acceptance and Modification of ToU

By accessing the Website and using the Services, you agree to be bound by these ToU and accept to comply with all applicable laws. Should you not agree to any terms and conditions of these ToU, in whole or in part, you may refrain from accessing the Website and using the Services. Your continued use of the Website and the Services shall be deemed as your acceptance of these ToU.

MT4talk reserves the right to update these ToU and to change or discontinue any aspect or feature of the Website at any time without notice to you. Any updates to these ToU, and any changes or modifications to any aspect or feature of the Website and Services shall become effective immediately. Your continued use of the Website and Services shall be deemed as your acceptance of such updates, changes or modifications.

2. The Services

MT4talk is a self-service forex trading robot forum where you may:

1. Upload User Generated Content (as defined below) onto the Website;
2. Advertise using MT4talk’s Sticky Topic Advertisement and/or Forum Signature Advertisement options; and
3. Participate in chats/exchanges between users in forum rooms,

hereinafter collectively referred to as the “Services”.

The Services are available to all users aged 18 years or more. For the avoidance of doubt, no persons under the age of 18 years of age are permitted to access the Website and use the Services.

You agree that when using the Services, you will not:

1. Post any material which is knowingly false and/or defamatory, inaccurate, abusive, vulgar, hateful, harassing, obscene, profane, sexually-oriented, threatening, invasive, or otherwise, in violation of any law;
2. Insult or threaten any other user or the MT4talk’s staff members;
3. Publish emotional groundless accusations against other persons or MT4talk;
4. Accuse any user of scamming without providing reasonable and adequate proof;
5. Post incorrect information which are not applicable to the subject matter of a particular forum or conversation thread;
6. Illegally distribute copyrighted software, e-books, and/or articles;
7. Post an article without providing a link to the original source of the article;
8. Upload duplicated Forex Trading Robots. Prior to uploading any Forex Trading Robot to the Website, you shall use the search option on the Website to ensure that the Forex Trading Robot you wish to upload has not been previously uploaded by another user;
9. Publish private data including but not limited to passwords, banking details, email addresses, and copies of documents;
10. Copy and paste content. You shall create your posts using MT4talk’s built-in formatting tool buttons only.

MT4talk has no obligation to monitor the Services, however, MT4talk reserves the right to (i) review and remove any of the Services in its sole discretion; (ii) terminate your access to any or all of the Services at any time, without notice, for any reason whatsoever; (iii) disclose any information as MT4talk deems necessary to comply with any applicable law, regulation, legal process or governmental request, and/or (iv) edit, refuse to post or to remove any information in whole or in part in MT4talk 's sole discretion.

MT4talk does not control, support, or endorse the content, messages, Forex Trading Robots or information found on the Website and, therefore, MT4talk specifically disclaims any liability with regard to the Website’s content(s), the Services, and any actions resulting from your use of the Services and the Website.

Your use of the Services for any other purpose other than expressly provided by MT4talk under these ToU is prohibited and may result in applicable legal action being taken by MT4talk against you and may result in the application of civil and criminal penalties being imposed on you. MT4talk shall prosecute users who violate these ToU to the maximum extent possible under the law.

3. User-Generated Content

MT4talk provides a Website platform that allows you to submit, post, and upload (on to the Website) open-source Forex Trading Robots, image files, text files, HTML, zip files, ex4 files, and MQ4 files only (“User Generated Content”).

All User-Generated Content shall be for information purposes only. While MT4talk shall endeavor to provide you with accurate information on its Website, MT4talk shall not be responsible for the accuracy or reliability of User Generated Content. As such, you agree to access the Website and use the Services at your own risk. You shall be solely and exclusively responsible for all User Generated Content you upload or post on the Website. You hereby grant MT4talk (i) an irreversible, non-exclusive, royalty-free and fully-paid, worldwide license to reproduce, distribute, publicly display and perform, prepare derivative works of, incorporate into other works, and otherwise use and exploit your User Generated Content, and (ii) the right to include the User Generated Content on the Website. You hereby irreversibly waive any claims and assertions of moral rights or attribution with respect to your User-Generated Content.

Only open-source forex trading software used to automate online trading decisions/signals (“Forex Trading Robots”) shall be uploaded by you onto the Website. MT4talk prohibits the uploading of copyrighted, hacked, or illegal versions of forex trading robots on to the Website. MT4talk may remove any copyrighted hacked or illegal versions of forex trading robots from its Website and may close your Member Account (defined below) should you upload copyrighted, hacked, or illegal versions of forex trading robots on to the Website. Forex Trading Robots that have been uploaded on the Website, may undergo a simulated back-test on an actual forex account by our tester team, solely for the purposes of providing you with a starting point for your own back-test and for educational purposes only.

You agree that when using the Website, you will not:

1. Collect, upload, transmit, display, or distribute any User-Generated Content that (a) violates any third-party right or any intellectual property or proprietary right; (b) is unlawful, harassing, abusive, tortious, threatening, harmful, invasive of another’s privacy, vulgar, defamatory, false, intentionally misleading, trade libelous, pornographic, obscene, patently offensive, promotes racism, bigotry, hatred, or physical harm of any kind against any group or individual; (c) is harmful to minors in any way; or (d) is in violation of any law, regulation, or obligations or restrictions imposed by any third party;
2. Upload, transmit, or distribute to or through the Website any software intended to damage or alter a computer system or data;
3. Upload files that contain viruses, Trojan horses, worms, time bombs, cancelbots, corrupted files, or any other similar software or programs that may damage the operation of another's computer or property of another;
4. Send through the Website unsolicited or unauthorized advertising, promotional materials, junk mail, spam, chain letters, pyramid schemes, or any other form of duplicative or unsolicited messages;
5. Harvest, collect, gather, or assemble information or data regarding other users' information without their consent;
6. Interfere with, disrupt, or create an undue burden on servers or networks connected to the Website, or violate the regulations, policies, or procedures of such networks;
7. Attempt to gain unauthorized access to the Website, whether through password mining or any other means;
8. Upload files with extension PHP, php3, php4, exe, com, and bat;
9. Harass or interfere with any other user’s use and enjoyment of the Website; or
10. Use the software, automated agents, or scripts to produce multiple accounts on the Website, or to generate automated searches, requests, or queries to the Website.

You shall bear sole and exclusive responsibility for the creation of backup copies of the User Generated Content (including Forex Trading Robots) you upload onto the Website. MT4talk accepts no responsibility whatsoever for any loss of data.

4. Advertising

MT4talk provides you with the ability and option to advertise on the Website through either:

1. “Sticky Topic Advertisement(s)” allows you to create an advertisement for a fee, on a specific topic, which is placed at the top of the Website and may include your email address, phone number, and website URL. Sticky Topic Advertisements are sent out (i) three times a week to all users who have subscribed to MT4talk’s newsletter; (ii) once a week on the web browser push notification message to all users who have subscribed to the web browser push notification message alert; (iii) to all users who have subscribed to the web browser email notification alert; and (iv) each time you reply to your post or add a new attachment to your post. All posts that you have created for advertising purposes must be upgraded to a Sticky Topic Advertisement. Should you fail to upgrade a post created for advertising purposes to a Sticky Topic Advertisement, MT4talk may delete the post and prevent you from advertising on the Website in the future;
2. “Forum Signature Advertisement” allows you to include the website URL of your website in your post.

When advertising on the Website, you agree that you shall not:

1. Post advertisements that promote any illegal activity, including but not limited to hacking or distribution of counterfeit software;
2. Violate MT4talk’s rules and/or policies for advertisements;
3. Post advertisements that promote or contain malware, spyware, or other malicious software; and
4. Violate any law or regulation.

MT4talk may remove any advertisements that it deems to be in violation of the above terms at its sole discretion.

5. MT4talk Pro Membership

MT4talk offers a PRO membership, allowing you to download unlimited files from forum posts. Even though the site usually doesn't provide support for downloaded Forex robots, if you're new to Forex and need help, you can buy the MT4talk dedicated support membership from the MT4talk forum. The MT4talk Dedicated support subscription is only available for purchase for MT4talk PRO members.

The MT4talk Team also provides an Artificial Intelligence Forex robot called "MT4talk Forex AI Signal - Trade Executor EA" to PRO members. However, this Forex robot is only a bonus and is not included in the original PRO membership.

Updates for the Forex robots may be limited or nonexistent, depending on the creator. If you choose to download any Forex robot or setting file from the forum, you acknowledge that you are using it at your own risk. MT4talk PRO membership is a digital product. Therefore, after you complete the PRO membership purchase, there is no refund available!

6. Affiliates Disclaimer

The website may have links to partner websites, and if you sign up and trade through these links, we will receive a commission. Our affiliate partners are FXOpen, FBS, LQDFX, and MyForexVPS.

7. Disclaimer

MT4talk conducts real-life tests on Forex robots to assess their performance. For certain robots, we may use a demo account to conduct tests, and for other Forex robots, we may use a real Forex account. It's essential to recognize that we are not financial advisors and cannot provide investment guidance. Our objective is to discover effective market analysis solutions through testing various strategies, which could be beneficial to our community.

8. CFTC Rule 4.41

HYPOTHETICAL OR SIMULATED PERFORMANCE RESULTS HAVE CERTAIN LIMITATIONS. UNLIKE AN ACTUAL PERFORMANCE RECORD, SIMULATED RESULTS DO NOT REPRESENT ACTUAL TRADING. ALSO, SINCE THE TRADES HAVE NOT BEEN EXECUTED, THE RESULTS MAY HAVE UNDER-OR-OVER COMPENSATED FOR THE IMPACT, IF ANY, OF CERTAIN MARKET FACTORS, SUCH AS LACK OF LIQUIDITY. SIMULATED TRADING PROGRAMS, IN GENERAL, ARE ALSO SUBJECT TO THE FACT THAT THEY ARE DESIGNED WITH THE BENEFIT OF HINDSIGHT. NO REPRESENTATION IS BEING MADE THAT ANY ACCOUNT WILL OR IS LIKELY TO ACHIEVE PROFIT OR LOSSES SIMILAR TO THOSE SHOWN.

9. General Disclaimer

No representation is being made that any Forex account will or is likely to achieve profits or losses similar to those shown on backtests in this forum. In fact, there are frequently sharp differences between hypothetical performance results and the actual results subsequently achieved by any particular trading program. Hypothetical trading does not involve financial risk, and no hypothetical trading record can completely account for the impact of financial risk in actual trading.
